1. Agreement to Terms

By accessing or purchasing from GirlStack, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use our services.

2. Eligibility

You must be at least 18 years old to purchase from GirlStack. By making a purchase, you confirm that you are 18 or older.

3. Products and Services

GirlStack provides pre-made AI influencer models, including photo libraries and monetization guides. All products are digital and delivered via instant download.

4. Purchases and Payment

  • All prices are in USD and subject to change without notice

  • Payment is required at the time of purchase

  • We accept major credit cards and digital payment methods

  • All sales are processed securely through our payment provider

5. Refund and Correction Policy

All sales are final. Due to the digital nature of our products and the exclusivity guarantee (once purchased, a model cannot be resold to others), we do not offer refunds.

Quality Guarantee: If you discover a technical error in your model's photos (such as mismatched earrings, distorted fingers, or other AI generation artifacts), we will correct and replace the affected images at no charge. This does not include requests for style changes, outfit swaps, or subjective preferences.

6. Model Exclusivity

Once you purchase a model, she is exclusively yours. We guarantee that no other customer can purchase the same model. This exclusivity is permanent and non-transferable.

7. Usage Rights and Restrictions

What You CAN Do:

  • Use your purchased model for commercial purposes across any platform

  • Create social media accounts using your model

  • Monetize content featuring your model through sponsorships, subscriptions, affiliate marketing, etc.

  • Post, share, and distribute content featuring your model

What You CANNOT Do:

  • Resell, redistribute, or transfer the original model files to anyone

  • Remove watermarks from unpurchased preview images

  • Share your model's photo library with others

  • Claim the model files as your own creation for resale purposes

Unauthorized Use: Using a GirlStack model without purchasing (including removing watermarks, downloading preview images, or obtaining files through unauthorized means) constitutes theft of intellectual property and will result in legal action.

8. Copyright and DMCA

All GirlStack models and content are protected by copyright law. GirlStack retains all intellectual property rights to the underlying creations and technology.

Copyright Infringement: If you use, copy, or distribute GirlStack models without authorization, you will be subject to:

  • Immediate cease and desist notice

  • Legal action including claims for damages

  • Responsibility for all legal fees and costs incurred by GirlStack in enforcing our rights

  • Potential criminal penalties under applicable copyright law

We take copyright violations seriously and will pursue all available legal remedies.

9. Platform Compliance

You are responsible for complying with the terms of service, community guidelines, and content policies of any platform where you use your AI model (Instagram, TikTok, OnlyFans, etc.). Some platforms require disclosure of AI-generated content - it is your responsibility to follow their rules.

GirlStack is not responsible for account suspensions, bans, or policy violations on third-party platforms.

10. Indemnification

You agree to indemnify, defend, and hold harmless GirlStack, its owners, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorney fees) arising from:

  • Your use or misuse of GirlStack products

  • Your violation of these Terms of Service

  • Your violation of any third-party rights, including intellectual property or privacy rights

  • Your use of AI models on third-party platforms

  • Any content you create or distribute using GirlStack models

11. Content Disclaimer

All GirlStack models are AI-generated and do not depict real people. Any resemblance to actual persons is coincidental. Models are created using artificial intelligence technology and are entirely fictional.

12. Intellectual Property

All GirlStack models, photos, guides, and materials are protected by intellectual property laws. Upon purchase, you receive a license to use the model commercially, but GirlStack retains ownership of the underlying creation and technology.

13. Limitation of Liability

GirlStack is provided "as is" without warranties of any kind. We are not liable for:

  • Lost profits or revenue from using our models

  • Platform bans or suspensions

  • Technical issues with downloads or files

  • Results or earnings from monetization efforts

  • Any indirect, incidental, special, or consequential damages

Your use of GirlStack products is at your own risk. In no event shall GirlStack's total liability exceed the amount you paid for the product in question.

14. Dispute Resolution and Arbitration

Binding Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or your use of GirlStack shall be resolved through binding arbitration rather than in court, except that you may assert claims in small claims court if your claims qualify.

Arbitration Process: Arbitration will be conducted by a neutral arbitrator in accordance with the American Arbitration Association (AAA) rules. The arbitration will take place in Wisconsin, and the arbitrator's decision will be final and binding.

Class Action Waiver: You agree that any arbitration or legal proceeding shall be limited to the dispute between you and GirlStack individually. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Exceptions: Either party may seek injunctive or equitable relief in court to prevent infringement or misuse of intellectual property rights.

15. Modifications to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of GirlStack after changes constitutes acceptance of the new terms.

16. Governing Law

These Terms are governed by the laws of the State of Wisconsin, United States, without regard to conflict of law provisions.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
